Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: the period within which the consumer can exercise the right of withdrawal;
Consumer: a natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur;
Day: calendar day;
Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information;
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
Model form: the model withdrawal form provided by the entrepreneur which the consumer can complete when wishing to exercise the right of withdrawal;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: an agreement concluded within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract;
Means of distance communication: a method that can be used to conclude an agreement without the consumer and entrepreneur being in the same place at the same time;
General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the terms can be inspected at the entrepreneur’s premises and will be sent free of charge upon request.

If the contract is concluded electronically, the terms may be provided electronically in such a way that the consumer can easily store them on a durable data carrier.

If specific product or service conditions also apply, the consumer may always rely on the provision most favorable to them in case of conflicting terms.

If any provision is void or annulled, the rest of the agreement remains valid, and the provision will be replaced by one that reflects its original intent as closely as possible.

Situations not covered by these terms must be assessed in the spirit of these terms.


Article 4 – The offer

If an offer has a limited validity or is subject to conditions, this will be explicitly stated.

The offer is non-binding. The entrepreneur may change or adjust it.

The offer contains a complete and accurate description of the products/services. Images are a true representation, though obvious errors do not bind the entrepreneur.

All images and specifications are indicative and cannot lead to compensation or termination. Colors may differ from reality.

Each offer includes clear information about rights and obligations, including:

  • price (including taxes)

  • shipping costs

  • how the contract is concluded

  • whether the right of withdrawal applies

  • payment, delivery, and execution methods

  • acceptance period

  • communication costs (if applicable)

  • whether the contract is archived

  • how data can be checked/corrected

  • available languages

  • applicable codes of conduct

  • minimum duration (for ongoing contracts)


Article 5 – The agreement

The agreement is concluded when the consumer accepts the offer and meets the conditions.

Electronic acceptance is confirmed immediately. Until confirmation, the consumer may dissolve the agreement.

The entrepreneur ensures appropriate security for electronic transactions.

The entrepreneur may assess whether the consumer can meet payment obligations and may refuse orders with justification.

The consumer will receive key information, including:

  • complaint address

  • withdrawal conditions

  • warranty information

  • contract details

  • termination requirements (if applicable)

All agreements are subject to product availability.


Article 6 – Right of withdrawal

For products:
Consumers may withdraw within 14 days after receiving the product.

They must handle the product carefully and return it (if withdrawing) with all accessories, preferably in original condition and packaging.

The consumer must notify the entrepreneur within 14 days and return the product within 14 days after notification.

If not done in time, the purchase is final.

For services:
Consumers may withdraw within at least 14 days from the date of agreement.


Article 7 – Costs in case of withdrawal

The consumer bears the return shipping costs.

Payments will be refunded within 14 days after withdrawal, provided the product is received or proof of return is provided.

If the product is damaged due to improper handling, the consumer is liable for loss of value.


Article 8 – Exclusion of the right of withdrawal

Withdrawal may be excluded for products such as:

  • custom-made items

  • personal items

  • perishable goods

  • sealed products (if opened)

  • newspapers/magazines

  • audio/video/software with broken seals

Also for services like:

  • accommodation, transport, catering on specific dates

  • services started with consent before the withdrawal period ends

  • betting/lotteries


Article 9 – The price

Prices will not increase during the validity period, except due to VAT changes.

Variable pricing may apply for market-dependent products.

Price increases are only allowed under legal conditions.

All prices include VAT and are subject to errors.


Article 10 – Conformity and warranty

Products/services must comply with the agreement and legal standards.

Legal warranty applies to all products.

Defects must be reported within 2 months.

Warranty does not apply if:

  • the product is altered or repaired improperly

  • used incorrectly or negligently

  • affected by government regulations


Article 11 – Delivery and execution

Orders are processed carefully and delivered to the provided address.

Delivery occurs within 30 days unless agreed otherwise.

If delayed, the consumer may cancel free of charge.

Risk transfers upon delivery.


Article 12 – Duration transactions

Consumers may terminate ongoing contracts with up to one month’s notice.

Fixed-term contracts may be terminated at the end of the term.

Automatic renewal rules apply, with protections for consumers.


Article 13 – Payment

Payments must be made within 7 working days unless agreed otherwise.

Incorrect payment details must be reported immediately.


Article 14 – Complaints procedure

Complaints must be submitted within 2 months.

They are handled within 14 days.

If unresolved, disputes may be submitted to an independent committee.


Article 15 – Disputes

Dutch law applies.
The Vienna Sales Convention does not apply.


Article 16 – Additional or deviating provisions

Any additional provisions must not disadvantage the consumer and must be recorded in writing or on a durable data carrier.
